Information Clause on the Processing of Personal Data


Due to Art. 13 Section 1 and Section 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as “the GDPR”, we would like to inform you that:

The Administrator of your personal data is PBS IT Sp. z o.o., based in Odrano–Wola (05-825), Błękitna 21C, a company entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XIV Commercial Department of the NCR under number 0000382284, NIP (Tax Identification Number) 5291793780, REGON (National Business Registry Number) 142876771 (“Administrator”).

The Administrator has appointed Kinga Seweryn as a Personal Data Protection Inspector, who can be contacted at the e-mail address: iod@probs.pl or by sending correspondence to the address of the Administrator's registered office with the note "IOD";

Your personal data is processed by PBS IT Sp. z o.o., based on:

  • Art. 6 Section 1(a) of the GDPR, if such consent is required in a given process,
  • according to Art. 6 Section 1(b) of the GDPR in the scope of:
    • activities aimed at concluding a contract (including preparing commercial information),
    • conclusion of the contract and its subsequent management,
    • carrying out identification or verification and checking identity in connection with the concluded contract,
    • making current settlements, considering possible complaints and claims.
  • Art. 6 Section 1(c) of the GDPR in the scope of:
    • documenting the settlement of contracts for tax and accounting purposes,
  • Art. 6 Section 1(f) of the GDPR in the scope of:
    • pursuing the legally justified interest of the administrator consisting in the possible determination or pursuit of claims or defense against claims.

Your personal data will not be transferred to other entities, with the exception of entities authorized to process them under the provisions of applicable law and entities providing services that are necessary for ongoing functioning, with which the Administrator has concluded contracts for entrusting data processing, in accordance with Art. 28 of the GDPR;

Your personal data will be processed:

  • until consent is withdrawn and/or no longer than until the end of the case during which the data was collected on the basis of consent,
  • for the period resulting from the concluded contracts, as well as for the period necessary to settle them and submit any claims,
  • for a period not longer than 5 years counted from the end of the calendar year in which the final settlement of the contract took place,

According the GDPR, you have:

  • the right to access personal data, in accordance with Art. 15 of the GDPR,
  • the right to rectify your personal data, in accordance with Art. 16 of the GDPR,
  • the right to request the Administrator limit the processing of personal data, in accordance with Art. 18 of the GDPR, however, subject to the cases referred to in Art. 18 section 2 of the GDPR,
  • the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal in relation to data processed on the basis of your consent, pursuant to Art. 6 section 1(a) of the GDPR,
  • the right to delete personal data, in accordance with Art. 17 of the GDPR, regarding the data to which you have consented,
  • the right to object to the processing of data for reasons related to your particular situation, if the processing of your data will take place on the basis of the premises specified in Art. 6 section 1(f) of the GDPR, taking into account the provisions of Art. 21 of the GDPR,
  • the right to lodge a complaint with President of the Office of Personal Data Protection if you believe that the processing of personal data violates the provisions of applicable law;
  • the telephone number provided in the contact form is used by the administrator only for contact for information purposes, and your consent to its use may be withdrawn at any time by sending an e-mail to kontakt@probs.pl.

Your data will not be processed in an automated manner, which means that the right to data portability specified in Art. 20 of the GDPR, in the scope of data processing covered by the purpose specified in points 3(a) and (b) are not used here.


8.

The provision of personal data by you is voluntary:

  • however, it enables the Administrator to contact you when following the process of conclusion or performance of an agreement by your Employer.
  • Refusing to provide personal data or demanding their removal prevents the Administrator from contacting you.

9.

Your personal data will not be used to make decisions that are based solely on automated processing, including profiling.
