Information on personal data processing

 

In view of Article 13, paragraphs 1 and 2 of the European Parliament and of the Council (EU) Regulation 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/WE, hereinafter referred to as "GDPR", we inform you of the following:

1.      The Administrator of your personal data is PBS IT Sp. z o.o. and PRO BUSINESS SOLUTIONS CONSULTING Sp. z o.o. Sp. k., both headquartered in Odrano-Wola (05-825), Błękitna 21 C (hereinafter referred to as "the Administrator");

3.      Your personal data are processed by PBS IT Sp. z o.o. on the basis of:

a)      Article 6, paragraph 1, point (a) of the GDPR if such consent is required in a certain proces,
b)     Article 6, paragraph 1, point (b) of the GDPR within the scope of:

·         czynności zmierzających do zawarcia umowy (w tym przygotowania informacji handlowej),
·         taking steps aimed at conclusion of the agreement (incl. preparation of business information),
·        conclusion of the contract and its subsequent handling,
·        carrying out identification or verification and checking the identity in connection with the concluded contract,
·        making current accounts, reviewing possible customer complaints and legal claims. 

c)       Article 6, paragraph 1, point (c) of the GDPR in the case of::

·         documenting contracts account for tax and balance-sheets purposes,

d)      Article 6, paragraph 1, point (d) of the GDPR within the scope of:

·        realization of a legitimate interest of the Administrator consisting of possible determinig or pursuing claims, or defending against claims.

4.      Your personal data will not be disclosed to other entities, except those authorized by law, based on the rules of applicable law, and to those entities providing services necessary for the current operation with which the Administrator has concluded relevant contracts for entrusting the processing of personal data in accordance with Article 28 of the GDPR;

5.      Your personal data will be processed:

a)      until the consent is withdrawn and/or not longer than until termination of the case which data has been collected on the basis of a consent,
b)      over the period of concluded contracts, as well as for the period necessary to settle contracts and for making any possible legal claims,
c)      for a maximum period of 5 years, counting from the end of the calendar year, in which the contract has been finally settled,

6.      You are entitled to:

a)      prawo dostępu do danych osobowych, zgodnie z art. 15 RODO, the right to access personal data, in accordance with Article 15 of the GDPR,
b)       the right to rectification of your personal data, under Article 16 of the GDPR,
c)      the right to request the Administrator to limit the processing of personal data, in accordance with Article 18 of the GDPR, however except for the cases mentioned in Article 18, paragraph 2 (GDPR),
d)      the right to withdraw the consent at any time without affecting the legality of the processing carried out prior to the withdrawal of the consent with respect to data processed on the basis of your consent, under Article 6, paragraph 1, point (a) of the GDPR,
e)      the right to erasure of data, in accordance with Article 17 of the GDPR, regarding the data you have given your consent,
f)      the right to object to the data processing for reasons related to your special situation, in the event Your data processing will take place on the basis of premise laid down in Article 6, paragraph 1, point (f) of the GDPR, having due regard to the Article 21 (GDPR),
g)      the right to lodge a complaint with President of the Office of Personal Data Protection if you believe that the processing of personal data violates the provisions of applicable law;

7.      Concurrently, you are not entitled to the right to transfer data, specified in Article 20 of the GDPR, in the field of data processing falling under the objective laid down in article 3, point (a) and (b) of this information, in view of the fact your data will not be processed by automated means;

8.      Providing the personal data:

a)      jest  is voluntary for data collected on the basis of consent, but the consequence of not providing personal data will be the inability to use some channels in order to communicate with the Administrator;
b)    is a voluntary contractual requirement, but the consequence of not providing personal data will be the inability to conclude a contract;
c)    is a requirement resulting from mandatory legal provisions;

9.      Your personal data will not be used to take decisions that rely solely on automated processing, including profiling.
