Information clause – Online application form for a job applicant
In view of Article 13, paragraphs 1 and 2 of the European Parliament and of the Council (EU) Regulation 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/WE, hereinafter referred to as "Regulation 2016/679" or "GDPR", we inform you of the following:
1. The Administrator of your personal data is PBS IT Sp. z o.o. and PRO BUSINESS SOLUTIONS CONSULTING Sp. z o.o. Sp. k., both headquartered in Grodzisk Mazowiecki (05-825), Błękitna 21 C (hereinafter referred to as "the Administrator");

3. Your personal data will be processed for the purpose of recruitment to a post defined in the application form based on a legal framework, i.e.:
a) Article 6, paragraph 1, point (c) of the Regulation 2016/679 (legal act of the Labour Code);
b) Article 6, paragraph 1, point (a) of the Regulation 2016/679 (a consent of the job applicant in the case of information which is beyond the scope defined in Article 221 §1 of the Labour Code);
4. The recipients of your personal data may be entities or subjects working on the basis of mandatory legal provisions. Your personal data can be entrusted to subjects who support ongoing operations of the Administrator with whom the Administrator has concluded contracts for entrusting the processing of personal data, in accordance with Article 28 of the Regulation 2016/679;
5. The period for processing of your personal data shall last:
a) until the process of recruitment to a defined post is completed, however no longer than 30 days since the application has been sent;
b) no longer than 6 months following the end of a year in which a consent has been made, in the case of consent for future recruitments;
6. You have::
a) the right to access personal data concerning your person, pursuant to Article 15 of the Regulation 2016/679;
b) the right to rectification your personal data, in accordance with Article 16 of the Regulation 2016/679;
c) the right to request the administrator to limit the processing of personal data, pursuant to Article 18 of the Regulation 2016/679, however except for the cases mentioned in Article 18, paragraph 2 of the Regulation 2016/679;
d) the right to erasure of personal data, in accordance with Article 17 of the Regulation 2016/679, regarding the data you have given your consent;
e) the right to file a complaint to the supervisory body – the President of the Office for Personal Data Protection, once you decide that the processing of personal data violates mandatory legal provisions;
f) the right to withdraw your consent at any time without affecting the legality of the processing carried out prior to the withdrawal of the consent with respect to data processed on the basis of your consent, pursuant to Article 6, paragraph 1, point (a) of the Regulation 2016/679;;
7. Concurrently, you are not entitled to the right to object the processing of personal data due to the legal basis for processing your personal data is Article 6, paragraph 1, point (a) of the Regulation 2016/679 in the field of data processing falling under the consent and Article 6, paragraph 1, point (c) of the Regulation 2016/679 within the scope of data processing deriving from legal obligation incumbent on the Administrator, as well as the right to transfer data with regard to the processing of personal data covered under the contract, in view of the fact that the data will not be processed by automated means;
8. Providing your personal data is:
a) a statutory requirement in the case of information processed on the basis of the Labour Code's legal act, but the consequence of not providing personal data will be inability to comply with the formal requirements which will result in rejection of the offer,
b) voluntary for data collected on the basis of a consent;
9. Your personal data will not be used to take decisions that rely solely on automated processing, including profiling.
